Terms and Conditions

  1. The Promoter/Promotions

1.1 Blaa Giveaways (‘Promoter’) operate skill-based gaming competitions (“Promotions”) on their www.blaagiveaways.ie website (‘Website’) resulting in the allocation of pre-nominated prizes in accordance with their terms and conditions as set out herein.  Further monthly or bi-monthly Promotions affords participants opportunity to support featured non-profit charitable causes (“Charity”) by making a monetary payment to the Promoter to enter (“Entry Fee”), or via the alternative free entry route.

  1. Eligibility

 

2.1 The Competitions are open to all persons aged 18 and over and the age of majority in their country of residence except the Promoter’s employees. employee’s immediate families (meaning, spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and/or those living in the same household (whether related) all of whom are not eligible to enter or to win.

2.2 The Promoter reserves the right to close a customer’s account at any time, if they feel the customer is abusing the services, being abusive to other customers or staff or they have the belief that it is not genuinely the customer that is entering.

2.3 The Promoter reserves the right to refuse a customer’s entry at the Promoters discretion.

  1. Legal Undertaking

3.1 By entering a Competition the entrant (‘Entrant’’) will be deemed to have legal capacity to do so, and to have read and understood these terms and conditions and to be bound by them and by any other requirements set out in any related promotional material.

3.2 Competitions are governed by Irish Law and any matters relating to the Competition will be resolved under Irish Law and the Courts of Ireland shall have exclusive jurisdiction.

3.3 In the event of Entrants participating in a Competition online via the Website, and thereby accepting these terms and conditions the Entrant confirms that they are not breaching any laws in their country of residence regarding the legality of entering. The Promoter will not be held responsible for any Entrant entering any of the Promoters Competitions unlawfully.

  1. Competition Entry

4.1 All gaming competitions are skill-based and require an exercise of mental skill and/or Challenge to qualify for entry. A specified entry fee is payable per entry. Alternatively, there is a free entry route available to all competitions, further details of which are provided in the section 4.7 below.

4.2 In order to qualify to win a competition, the skill-based competition question and/or challenge must be correctly answered/resolved. Only those Entrants that have correctly answered the competition question will be entered into the competition draw. All entries with the incorrect answer will not be entered into the draw but may still be charged.

4.3 Competitions may be entered via the Website. Multiple competitions may be operated at the same time and each Competition will have a specific prize.

4.4 Availability and pricing of Competitions is at the discretion of the Promoter and will be specified at the point of entry on the Website.

4.5 In order to enter via Paid entry method, the Entrant will be required to register an online account on the Promoter’s website. To register an account online the Entrant will be asked to provide an email address or sign in via a social media account, such as Facebook, Twitter, or Gmail (‘Social Media Account’).

4.6 When playing a Competition online via the Website, the Entrant should follow the on-screen instructions to: (a) select the Competition they wish to enter and when ready to proceed with the Entry provide their contact and payment details. Entrants will need to check their details carefully (b) once entry has been purchased the Entrant should complete the Challenge. When payment has cleared and successful completion of the Challenge been verified, the Entrant will be contacted to confirm their entry into the Competition together with an Order Number and Ticket(s) Number(s). Please note that when entering online, Entrant will not be deemed entered the Competition until the Promoter confirms the Entry(s) order back to the Entrant by email.

4.7 Alternative method of entry: Entrants should send a postcard addressed to: Blaa Giveaways, 4 Market Street, Tramore, Co. Waterford X91 R277 containing the following information: Name, Address, Date of Birth, E Mail address, Contact phone number, Selected competition identified/nominated, Answer to the nominated specific skill-based competition question/challenge.

4.8 Postal entries are limited to one entry per person per competition. No mechanically reproduced entries are permitted. Illegible and/or incomplete entries are void. The Promoter will not accept responsibility for competition entries that are not successfully completed, are lost, late, mutilated, delayed, inaccurate, incomplete, postage due, misdirected entries or entries not received by the last day of availability/the applicable entry period i.e., 24 hours prior to the closing date. All competition entries received after the specified time are deemed automatically disqualified.

4.9 By purchasing entries and submitting a competition entry, the Entrant is entering into a contract with the Promoter and is agreeing to be bound by these terms and conditions. By submitting an alternative method entry to the competition, the Entrant is entering into a contract with the Promoter and is agreeing to be bound by these terms and conditions. Alternative method entries will be entered into the ‘Live Draws’ in the same manner. Standard competition terms and conditions apply for alternative method entries.

4.10 The Promoter reserves the right to refuse or disqualify any incomplete Entries if it has reasonable grounds for believing that an Entrant has contravened any of terms and conditions herein.

4.11 To the extent permitted by applicable law, all Entries become the property of the Promoter and will not be returned.

4.12 The competition closes when the last specified number is taken, no more entries after this point will be accepted.

  1. Promotion Periods

5.1 Each Competition will run for a specified period. Please see each Competition for details of start and end times and dates (‘Promotion Period(s)’).

  1. Competition Judgement/ Winner Notification Process

6.1 A validated and 100% independent random number generator will determine the winner of each competition via live Stream on the Promoter’s social media channel Facebook, date of which will be advertised on said channel in advance.

6.2 Due to the nature of the winning judgment there will only be one winner per competition unless clearly stated otherwise in the description of the competition.

6.3 The Promoter will attempt to contact Winners using the telephone numbers and email address provided at the time of Entry (or as subsequently updated) and held securely in the Promoters database. It is the Entrant’s sole responsibility to check and update their account details. If for any reason the information supplied by the Entrant is inaccurate, the Promoter will not be held responsible. Therefore, Entrants must carefully check they have recorded their contact details correctly at the time of entry and keep same updated thereafter.

6.4 While Winners will always be contacted via phone number and/or email address furnished after each prize draw, if for any reason the Promoter is unable to contact a Winner within 5 days after the end of a Competition (which may be extended at the sole discretion of the Promoter) or the Winner fails to confirm acceptance of the prize or the Winner is disqualified as a result of contravening any of these Terms and Conditions, the Winner may be disqualified or may forfeit their claim to the prize.

6.5  No person will be confirmed as a winner of any competition unless they have satisfied all requirements of these Terms and Conditions.

6.6 In order to verify their identity and eligibility, Entrants may be required to provide identification to verify they comply with the Terms and Conditions in relation to such matters therein such as age.

6.7 In the event that the Promoter closes a Competition early, the Winner will be selected from all valid and eligible Entries received by the Promoter prior to the date of closure. The Promoter also reserves the right at its sole discretion to extend the closing date of any Competition.

6.8 All Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by the Promoter.

6.9 In the unlikely event a competition has not reached its maximum number of Entrants within the specified time limit, the Promotor reserves the right to extend the competition close date up to a maximum of 2 no. times, or 21 days total from the original specified date. If a competition has not sold out within these permitted time extensions, then the allocated prize for the competition may be substituted at the Promoters discretion with a cash prize of 70% of the total competition fund.

  1. Winner’s Personal Data/Publicity

7.1 The Prize Winner may be required to show proof of identification on delivery of the prize. Any failure to meet this obligation may result in the Winner being disqualified and the Promoter retaining the prize.

7.2 The Promoter reserves the right to publish or make available information confirming that a valid competition award took place for each of the prizes such as the first name/surname and county of residence of the Winner. Winners have the right to object to all or part of this information being made available. In this event, a request should be made in writing or via email to the Promoters contact address at the end of these Terms and Conditions. The Promoter will also require that winners participate in any reasonable requested publicity in the form of a photograph or video of the Winner accepting the prize. Said material may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.

 

  1. Prizes

8.1 Prizes are selected and purchased by the Promoter with the specifics identified on the competition page at the point of entry and this is the prize the winner will be allocated. All prizes are awarded as is unless specifically stated and cannot be substituted unless outlined in the entry rules. Actual prize(s) to be awarded may not be identical to those depicted which are intended to be only representative. The Promoter reserves the right to substitute a prize with an alternative item of comparable or greater value or cash. Once delivered, the Promoter takes no responsibility in respect of the prize awarded and it is therefore not insured by the Promoter. No insurances come with the prizes and the Promoter cannot be held responsible for any prize once handed over to the winner.

8.2 Prizes involving vehicles will be delivered as is and Winners will be responsible for any applicable fees and expenses including insurance, tax, NCT, fuel and maintenance. The winner must take the vehicle at a mutually arranged delivery point and date.

8.3  Prizes incorporating travel may have specified travel dates and itinerary which must be adhered to other than at the possible discretion of the nominated Travel Agent. Where the travel prize is for two people, both people must travel on the same itinerary.  Lost or stolen gift cards, tickets, travel vouchers or similar items once in the possession of the Winner are the sole responsibility of the Winner. Any expenses not specified in the rules, including, but not limited to, checked baggage fees, meals and gratuities, transfers, and ground transportation, are the sole responsibility of Winner and Winner’s guest(s). Travel and accommodation are always subject to availability as specified in the competition and certain additional restrictions and blackout dates may apply. If specific dates are indicated for travel, and Winner cannot travel on those specified dates, a cash alternative may be offered but only at the sole discretion of the Promoter. Winner and Winner’s guest(s), if applicable, are responsible for all required travel documentation and identification including, without limitation and as applicable passports or visa if necessitated, as well as meeting any other requirements for entry into the applicable destination. Winners are advised to consult with their medical practitioner and the nominated travel agent to establish if Vaccinations are required and Winners are responsible for any costs incurred as a result.

8.4  Delivery to the winner is free within Ireland. The Promoter has a right to charge the winner delivery fees if they want the prize delivered anywhere other than within the specified areas.

8.5 All Entrant expenses are the sole responsibility of the Winners.

8.6 All prizes are subject to the Terms and Conditions of the prize provider, manufacturer, supplier, or retailer.

8.7 Each prize must be accepted as awarded and is non-transferable or convertible to other substitutes and cannot be used in conjunction with any other vouchers, offers or discounts, including without limitation any vouchers or offers of the Promoter or other prize suppliers.

8.8. The Promoter may store the applicable prize free of charge for 30 days after notifying the Winner, at the end of which time the Winner must take delivery.

  1. Limits of Liability

9.1 The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.

  1. Refund Policy

10.1 All competitions have a strict no refund policy. If a competition does not sell out by final countdown a cash alternative of 70% of the fund value may be substituted at the discretion of the Promoter as stated in section 6.9 and may therefore be the alternative prize awarded to the winner.

There are two scenarios in which a refund may be offered: See below 10.2 & 10.3.

10.2 If a competition has not met at least 10% of ticket sales within 24 hours of launch date then a full refund may be issued to all Entrants based on the decision of the Promoter.

10.3 If a competition has not met at least 25% of ticket sales within 7 days of launch date then a full refund may be issued to all Entrants based on the decision of the Promoter.

  1. Electronic Communications

11.1 No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes.

11.2 The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software, or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability.

11.3 In the event that the Promoter closes a Competition early, the Winner will be selected from all valid and eligible Entries received by the Promoter prior to the date of closure, except that the Promoter reserves the right, at its sole discretion, to close a Competition early without selecting a Winner.

11.4 In the event that a Competition is closed without selecting a Winner, the Promoter will give all Entrants Game Credit to enable them to replay equivalent tickets in a subsequent competition.

11.5 The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet, and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.

  1. Amendments

12.1The Promoter may revise the terms and conditions from time to time and will post the most current version on the website as soon as possible after the revised terms and conditions become effective. Please check this page periodically to ensure understanding of the terms and conditions that apply at that time. By continuing to access and/or use the website after the revisions come into effect, the Entrant agrees to be bound by the revised terms and conditions. The Promoter may also update and change the website, competitions from time to time to amongst other things reflect changes to offerings, website IT systems and/or our users’ needs and/or feedback.

  1. Data Protection Notice

13.1 Any personal data supplied to the Promoter or authorised for the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable. In order to process, record and use personal data the Promoter may disclose it to (i) any credit card company whose name is given; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with the Entrant; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose personal data, the Promoter may need to transfer such information, in which event the Promoter is responsible for ensuring that any such personal data continues to be adequately protected during the course of such transfer.
